01Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Samarpan — Holistic Wellbeing, operated by Harsh Ranjan ("Samarpan", "we", "us", or "our").

By using our website, booking any session, subscribing to our content, or applying to our community, you confirm that:

• You are at least 18 years of age, or have the consent of a parent or legal guardian.
• You have read, understood, and agree to be bound by these Terms.
• You agree to our Privacy Policy, which is incorporated into these Terms by reference.
• You have the legal capacity to enter into a binding agreement.

Samarpan is a holistic wellbeing practice offering Ayurvedic consultations, Yoga therapy, integrative psychology, meditation guidance, and wellness education. We operate online and in-person from New Delhi, India.

03Services Offered

Samarpan provides the following categories of services, subject to availability and at our sole discretion:

Consultations & Sessions

• Ayurvedic Consultation: Dosha assessment, Prakriti & Vikriti analysis, personalised diet, lifestyle, and herbal protocols.
• Yoga Therapy: Individualised yoga sequences, pranayama protocols, and therapeutic practices.
• Integrative Psychology: Trauma-informed, somatic, and mind-body sessions. Not a substitute for licensed clinical psychiatric care.
• Meditation & Consciousness Guidance: One-on-one instruction in meditation, mantra, and Vedic practices.
• Free Dosha Assessment: A complimentary 20-minute introductory session. This does not constitute a full consultation and carries no treatment obligation.

Digital & Community Services

• Wisdom Stream Journal: Educational articles on Ayurveda, Yoga, psychology, and Vedic sciences. All content is for informational purposes only.
• Inner Circle Newsletter: Monthly curated wellness insights delivered via email. Subscription-based, free of charge.
• Samarpan Community: A curated directory of holistic wellness practitioners. Membership is by application and at our sole discretion.

We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice where feasible.

04Medical Disclaimer

By engaging with our services, you acknowledge and agree to the following:

• Ayurveda, Yoga therapy, and integrative psychology are complementary wellness practices, not licensed medical services under the Indian Medical Council Act or equivalent legislation.
• Harsh Ranjan is a wellness practitioner and Ayurveda consultant. He is not a registered allopathic physician (MBBS), psychiatrist, or licensed clinical psychologist under Indian law.
• Nothing communicated during sessions, on our website, in articles, or via newsletter constitutes a medical diagnosis, prescription, or clinical treatment.
• You are solely responsible for consulting a qualified medical professional before making any changes to medications, treatments, or therapies based on our guidance.
• If you are experiencing a medical emergency, please contact emergency services (112 in India) immediately. Do not rely on our services for emergency situations.
• Results shared in testimonials are individual experiences and do not guarantee similar outcomes for any other person.

05Bookings & Payments

Booking Process

• Sessions may be booked via our website booking form, WhatsApp, or email.
• Bookings are confirmed only upon receipt of full payment (where applicable) and written confirmation from Samarpan.
• We reserve the right to decline any booking at our discretion, in which case any payment received will be refunded in full.
• Session times are in Indian Standard Time (IST) unless explicitly agreed otherwise.

Payments

• Fees are as stated at the time of booking and are in Indian Rupees (INR) unless otherwise specified.
• Payment is due in advance unless a specific deferred arrangement is agreed in writing.
• Accepted payment methods include UPI, bank transfer, and any other methods communicated at the time of booking.
• All fees are inclusive of applicable taxes unless otherwise stated.

Free Sessions

The complimentary 20-minute Dosha Assessment is offered at our discretion, limited to one per person, and is subject to availability. It does not create any obligation on either party to continue with paid services.

06Cancellations & Refunds

Cancellation requests must be communicated via email to info@thesamarpan.co.in or WhatsApp. The time of our receipt of the cancellation message determines the applicable policy.

Rescheduling

Sessions may be rescheduled without penalty if at least 24 hours' notice is provided. Rescheduling requests are subject to availability. Each booking may be rescheduled a maximum of two times; thereafter, standard cancellation terms apply.

Package & Multi-Session Programmes

For multi-session packages, refunds on unused sessions will be calculated on a pro-rata basis at the single-session rate, less any package discount applied. No refund is issued once more than 50% of sessions in a package have been consumed.

Digital Products & Newsletter

Journal articles, newsletter content, and other digital information provided free of charge carry no refund entitlement as they involve no payment.

07User Conduct

By using our website and services, you agree to conduct yourself with integrity, respect, and good faith. You agree not to:

• Use our website or services for any unlawful purpose or in violation of any applicable laws or regulations.
• Misrepresent your identity, credentials, or health condition in any communication with us.
• Copy, reproduce, distribute, or commercially exploit any content from our website without prior written permission.
• Attempt to gain unauthorised access to any part of our website, systems, or databases.
• Upload or transmit viruses, malware, or any harmful code.
• Harass, abuse, or disrespect our team or other community members in any communication channel.
• Use our services to solicit others for competing commercial purposes without our express written consent.
• Submit false, misleading, or defamatory content including reviews or testimonials.
• Share session content, recordings, or personal health information discussed in sessions with third parties without explicit consent.

We reserve the right to terminate access to our services without refund for any user who violates these conduct standards.

08Intellectual Property

All content on the Samarpan website — including but not limited to articles, text, photographs, graphics, logos, the Samarpan brand identity, session materials, and course content — is the exclusive intellectual property of Samarpan and Harsh Ranjan, protected under applicable Indian and international copyright law.

What You May Do

• Read and share links to our journal articles for personal, non-commercial purposes.
• Quote brief excerpts (not more than 100 words) with clear attribution to "Samarpan — thesamarpan.co.in".
• Download or print content solely for your personal, non-commercial reference.

What You May Not Do

• Reproduce, republish, or redistribute full articles or substantial portions of content without written permission.
• Use our brand name, logo, or Samarpan identity in any commercial context without authorisation.
• Claim authorship of, or present as your own, any content created by Samarpan or its contributors.
• Record, transcribe, or distribute session content without our explicit written consent.
• Use our content to train AI models or for automated data extraction.

09Newsletter & Community

Inner Circle Newsletter

• Subscription is free and voluntary. You may unsubscribe at any time via the link in any email or by contacting us directly.
• By subscribing you consent to receive periodic emails containing wellness content, seasonal guides, and service announcements from Samarpan.
• We will not share your email address with third parties for marketing purposes.
• The newsletter is informational in nature and does not constitute professional medical or psychological advice.

Samarpan Community Membership

• Membership is by application and entirely at our discretion. Submission of an application does not guarantee acceptance.
• Accepted members grant Samarpan the right to display their name, credentials, photograph, and professional bio on our community page for as long as they remain members.
• Members may request removal from the directory at any time by contacting us. Removal will be processed within 14 business days.
• Members are responsible for the accuracy of information provided in their profiles. Samarpan does not independently verify all credentials.
• We reserve the right to remove any member whose conduct is inconsistent with Samarpan's values of integrity, compassion, and professional ethics.

10Testimonials & Reviews

Testimonials displayed on our website represent the genuine experiences of individual clients. By providing a testimonial, you:

• Grant Samarpan a non-exclusive, royalty-free licence to publish your testimonial on our website, social media, and marketing materials.
• Confirm that the testimonial accurately reflects your personal experience.
• Agree that Samarpan may edit testimonials for length, clarity, or anonymisation while preserving the essential meaning.

Testimonials describe individual outcomes and are not a guarantee of results for any other person. Results vary based on individual constitution, consistency of practice, and numerous other factors.

11Limitation of Liability

Specifically, and without limiting the above, Samarpan shall not be liable for:

• Any adverse health outcomes arising from following wellness protocols provided during sessions or in our content, where you have failed to consult a qualified medical professional as advised.
• Any decisions made based on information in our journal articles, newsletter, or social media content.
• Any loss of data, business opportunity, or revenue arising from use of or inability to access our website.
• Any actions of third-party service providers (payment processors, video conferencing platforms, etc.).
• Any technical interruptions, errors, or unavailability of the website or online services.

Our total liability to you for any claim arising out of these Terms or our services shall not exceed the total fees paid by you to Samarpan in the three months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation, to the extent such exclusion or limitation is not permitted by law.

12Third-Party Links & Services

Our website contains links to third-party websites and platforms including Instagram, YouTube, and WhatsApp. These links are provided for your convenience only. We have no control over the content, privacy practices, or terms of these external sites and accept no responsibility for them.

Accessing any third-party website is at your own risk and is governed by that website's own terms and privacy policy. The presence of a link does not constitute an endorsement by Samarpan.

Our website uses third-party services including Google Fonts, Tailwind CSS CDN, and Lucide Icons for rendering. Use of our website implies acceptance of the data practices associated with these services.

13Privacy

Your use of our website and services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully to understand our data collection and usage practices.

In brief: we do not sell your data, we collect only what is necessary to deliver our services, and we respect your right to access, correct, and delete your personal information.

14Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of law provisions.

Dispute Resolution Process

• Step 1 — Informal Resolution: In the event of any dispute, we encourage you to contact us first at info@thesamarpan.co.in. We will make every effort to resolve any disagreement amicably within 30 days.
• Step 2 — Mediation: If informal resolution fails, both parties agree to attempt resolution through mediation before pursuing formal legal proceedings.
• Step 3 — Jurisdiction: Any unresolved dispute shall be subject to the exclusive jurisdiction of the courts of New Delhi, India.

If you are a consumer located in the European Union or United Kingdom, you may also have the right to refer disputes to your local alternative dispute resolution body under applicable consumer protection laws.

15Changes to These Terms

We reserve the right to modify these Terms at any time to reflect changes in our services, applicable law, or business practices. When we make material changes, we will:

• Update the "Last updated" date at the top of this page.
• Notify active clients and newsletter subscribers via email for significant changes.
• Post a notice on our website for a reasonable period.

Your continued use of our website or services after any changes take effect constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, please discontinue use of our services and notify us at info@thesamarpan.co.in.
